There are two parts to this assessment, each worth 50% of the final grade. You must answer both parts.

Part 1:
Kate is twenty-three years old and has recently walked away from an abusive relationship with Gareth. Kate was only nineteen, and a promising law student, when she met Gareth. Kate abandoned her studies when she met, and fell in love, with Gareth. Although at first Kate was very happy within the relationship, it quickly became controlling and abusive, both physically and mentally. It has taken Kate a long time to walk away from the relationship. Kate has not reported Gareth to the authorities and is currently living with her sister Maya. Kate simply wanted to put the relationship behind her and resume her studies in law.

Kate missed her period soon after moving in with Maya. She assumed that it was due to the stress and anxiety
of the situation. However, when Kate missed her period for a second month in a row Maya became quite concerned and brought her a pregnancy test.

Kate was devastated to learn that she was pregnant. She made a GP appointment to seek an NHS funded abortion. Kate was informed that an urgent referral would be made and that she would be contacted within a two-week period.

Kate contacted the GP surgery after two weeks as she had not heard anything back and was informed that one
of the receptionists Charlotte had refused to type the referral letter and send it on, on account of her religious beliefs. This had only been identified a couple of days ago during an administrative audit after which the referral letter was sent. Charlotte has subsequently had her employment contract terminated.

Kate was eventually seen, after a further three weeks, by a local NHS Clinic and informed that she was 17 weeks pregnant (gestation), much further along than she thought. The NHS Trust, under which the NHS Clinic operates, has a policy to carry out abortions up to 18 weeks’ gestation only. Kate is now struggling to decide whether she wants to have an abortion or not. The pregnancy is much further along than she thought and one week is simply not enough time for her to make a decision. Maya is additionally very concerned for Kate’s mental health if she is to go ahead with the pregnancy.

Kate is also concerned that she is visibly starting to look pregnant now and that someone might notice and that the news may travel back to Gareth. She knows that Gareth would never agree to her having an abortion.

Discuss any legal and ethical issues arising from the scenario presented.

Part 2:
‘The duty of confidence is correctly limited in English and Welsh law.’

Critically discuss the above statement with reference to appropriate legislation, case law and academic commentary. You will also need to consider any relevant ethical issues.
